The Texas Commission on Environmental Quality on Feb. 27 granted Williamson County’s hearing request and referred a petition to create the Bartlett Farm Municipal Utility District (Williamson County) to the State Office of Administrative Hearings, with the commission’s alternative dispute resolution program to run concurrently.
The petition seeks creation of a municipal utility district with additional road powers for territory in Williamson County. The commission’s staff and commissioners applied the statutory affected‑person test for district petitions and recommended that Williamson County qualify as an affected person because the proposed district is entirely within the county and the county identified statutory authorities relevant to road powers and other local impacts.
Commissioner Bobby Janeca praised staff diligence in reviewing district petitions, noting the agency’s duty under the Legislature to perform these reviews. The motion to grant Williamson County’s hearing request, refer the petition to SOAH and to the commission’s alternative dispute resolution program passed on an aye vote.
The referral will initiate contested‑case procedures and permit Williamson County to present evidence in a hearing about statutory factors the commission must consider when authorizing new districts.
