The El Paso City Plan Commission voted to approve a major combination plat for the McKelligan Business Center and granted the applicant’s request to waive three feet of sidewalk along Alabama Street.
The commission approved the proposal on a 5–2 roll-call vote during its Feb. 27 meeting. The plat covers a 1.05-acre site proposed to become a single commercial lot with vehicular access from Alabama Street. Planning staff recommended approval with the listed exceptions and modifications in the staff report.
The applicant sought one exception to match existing street conditions: to allow the sidewalk to abut the roadway and to waive three feet of additional sidewalk that would otherwise be required by El Paso City Code. Alex Alejandre, planning staff, told the commission the exception request “meets the criteria on El Paso City Code Title 19.”
During public questions the chair, Alfredo Borrego, pressed staff and the applicant on stormwater handling and whether runoff would be conveyed into Alabama Street. Borrego asked, “Why this business is not made or asked to keep their storm water and [not] allowed to go into the street?” Planning and inspections staff responded that the project was reviewed against the city’s master drainage plan and that, for this site, drainage by conveyance in the street was consistent with that plan.
Fermi Dorado of Dorado Engineering, speaking for the applicant, said the streets had been improved previously and that a drop inlet existed nearby. Dorado stated the applicant concurred with staff comments and did not object to the conditions recommended in the staff report.
Roll-call voting on the motion recorded several commissioners by name: Commissioner Masood voted yes; Chair Alfredo Borrego voted no. The motion carried 5–2. The approval included the sidewalk exception and the requirement that the applicant comply with all remaining staff-report conditions.
The commission forwarded its recommendation to city council as required by the commission’s procedures; the staff report notes full compliance with subdivision code requirements and lists the exception under Title 19 of the El Paso City Code as the legal basis for the waiver.
