Planning commission approves ABC license upgrade for Dos Mundos Kitchen with last-call condition

The Upland Planning Commission on Feb. 26 approved a conditional use permit to upgrade Dos Mundos Kitchen’s alcoholic beverage control license from a Type 41 (beer and wine) to a Type 47 (general eating place, allowing distilled spirits) for the restaurant at 425 North Mountain Avenue, and added a condition requiring last-call to be at least 30 minutes before closing.

Staff told commissioners the restaurant has occupied the building—constructed in 1984—and has operated under a Type 41 since a prior commission action in May 2024. The applicant proposed extending hours (applicant indicated a desire to operate to 1 a.m.), and staff said parking on site (83 spaces) exceeded the 50-space requirement. Staff recommended approval and said the project was categorically exempt from CEQA under Article 19, Section 15301 (existing facilities).

Rudy Lopez, speaking for the applicant’s liquor license agent, said the operation would remain a bona fide eating place and that the owner won an ABC lottery allowing the opportunity to upgrade the license. Lopez said the upgrade would permit traditional cocktails to complement the menu and that the operator did not intend live entertainment or nightclub uses. Asked why the applicant sought extended hours, Lopez said the later hour would allow patrons to sober up and that the business would abide by responsible service practices.

Commissioner Johnson proposed adding a condition requiring last drink service end 30 minutes before closing; the motion adopted by the commission added that condition under the planning division conditions of approval. The commission approved the resolution and CUP with seven affirmative votes.

The action allows Dos Mundos Kitchen to serve distilled spirits on-site as part of a full-service restaurant and adds a city condition that no alcoholic beverages be served within 30 minutes before closing to limit late-night service.
