Commission approves track-split exception for Raleigh property in Tallgrass Estates area

The Leavenworth County Planning Commission voted 7–0 to approve an exception for case DEV24-150, which would split approximately 8 acres containing an existing farmhouse and outbuildings from a larger tract that is part of the preliminary plat for Tallgrass Estates.
Planning staff said the request is for an exception to the lot depth-to-width ratio in Article 50 Section 40.3 (the county Zoning and Subdivision Regulations) for property at 16271 Evans Road. Staff said the applicant proposes to split off about 8 acres for the farmhouse and outbuilding while leaving roughly 51 acres for the remainder, which is moving forward under a preliminary plat approved by the commission on Oct. 9, 2024. Staff recommended approval and said the request meets the three criteria for an exception as documented in the staff report.
Commissioners asked about access and frontage along the collector road on the east side of Track 1 and whether driveway spacing or road-improvement plans would require further review. Planning staff replied that existing entrances would be addressed in the final plat submission and in associated road improvement plans, and that public works had no comments on access for this case.
A commissioner moved to approve the exception, and a second was recorded. Roll-call votes recorded Jaden Bailey, Alan Stewart, William Gaston, Jeff Spink, Doug Tystead, Steve Rosenthal and Dan Clemens voting yes; the motion carried 7–0.
Why it matters: The split was a condition tied to the preliminary plat for Tallgrass Estates. Approval allows the farmhouse parcel to be retained separately while leaving the remaining acreage subject to subdivision and future infrastructure improvements.
