The Midway City Council approved a legislative plat amendment to combine parcels 1, 2 and 3 within the Mirror Subdivision at 195 West Main Street into a single parcel, adopting staff findings that the combination is supported by good cause including tax consolidation, shared parking and simplified future development.
Staff and the applicants told the council the three primary reasons for the amendment are: (1) consolidation to reduce multiple tax bills, (2) consolidating parking so common, shared parking can be attributed to a single lot rather than separate lots, and (3) increasing contiguous buildable area to facilitate future improvements. The council’s approval was made subject to conditions: the applicant must submit an amended plat signed by each owner of record that meets county recording requirements, and the approved amended plat must be recorded within one year or the approval will lapse unless the council grants an extension.
Planning staff reminded the council and applicants that the city’s code provision allowing parking to straddle private property and the public right-of-way (Midway City Code §16.13.290) requires that the preserved green space be at least 45 feet wide and at least 0.15 acres; if that protected green area is later developed, the exception allowing street-area parking may no longer apply and the owner would need to provide on-site parking or pursue a lease arrangement with the city at council discretion.
Applicants represented they expect to continue the property’s restaurant and lawn uses; staff said no change to zoning or permitted uses was requested with the plat amendment. The council recorded votes in favor of the amendment with council members Lisa, Jeff, Craig, JC and Kevin recorded as voting yes.
Staff will process an amended plat for recording and follow up with the council if extensions or additional conditions are requested.
