Committee passes bill to limit ABC administrators' arrest powers to certified officers

The committee approved a cleanup bill that restricts the authority to make arrests by alcohol beverage control (ABC) administrators and investigators to those who are POST certified.
Representative Tony Hampton (D‑62) presented House Bill 437 and said the bill simply aligns the arrest authority of city and local ABC administrators and investigators with statutory requirements for other law enforcement personnel by ensuring arrest powers are limited to those who are POST certified.
Hampton said the measure does not alter other powers of ABC administrators or investigators and that the bill was developed in consultation with the state ABC office. The bill is supported by the Kentucky League of Cities, the Kentucky Sheriffs Association, and the Kentucky Police Chiefs Association, whose members testified in favor.
Pat Morgan of the Sheriffs Association said the bill protects civilian administrators who are not trained to make arrests. Committee members praised the sponsor for stakeholder outreach and described the bill as an example of effective corrective legislation.
The committee voted to advance the bill to the House floor; Chairman Cook congratulated Representative Hampton on moving the cleanup bill forward.
