Council approves preliminary plat tied to 700 East extension after land easement deal with property owner

Hyde Park City Council approved a preliminary plat on Feb. 12 that implements a negotiated land exchange related to the city’s grant-funded extension of 700 East.
Marcus, city staff, explained the city obtained a grant from the County Council of Governments to complete the roadway connection. Favorable bids allowed the city to expand the project scope southward, but completing the extension required acquiring right-of-way and a sewer easement across private property owned by Robert Balz. Under the agreement, Mr. Balz receives the ability to subdivide his property into two lots; in return the city receives an easement for a sewer line and necessary right-of-way for the road.
Marcus said the subdivision is a procedural step and does not include a development plan; Lot 1 will contain the existing home and Lot 2 is the remainder parcel (constrained by the canal). The city will pay for road improvements under the grant; where the city would normally require a subdivider to install utilities, the grant-funded work renders that requirement moot for this parcel. Marcus told the council the planning commission had asked the council to pursue legitimizing the canal trail easement and suggested staff should ask Mr. Balz about dedicating a public recreation easement for the canal trail; Mr. Balz told staff he would “talk about that later.”
Motion and vote: A councilmember moved to approve the preliminary plat for the Falls Family Trust (the Balz subdivision); another moved and seconded; the council approved the preliminary plat unanimously. Staff said final engineering and easement recording will follow as part of the road project and DRC review.
