The Leland Planning Board recommended approval of a zoning map amendment to rezone a 0.33-acre parcel at the corner of Parker Trail and King Bruce Trail from C-1 (general commercial) to R-15 (residential).
Planner Javier Barrera presented the item, noting staff considered consistency with the town's Leland 2045 plan and state statute (cited as General Statute 160D-605). Barrera described outreach steps staff took beyond statutory requirements: mailed notices to adjacent property owners, a sign posted on the property and a newspaper notice.
Applicant Rebecca Islas told the board she and her family moved from Wilmington to live on the parcel and said they plan to remain. "I do enjoy it's pretty peaceful out there... I don't have any intentions on going anywhere," Islas said, adding she and her husband had invested about $5,000 in rock and repairs to make the access more passable.
Barrera said the property is shown as "high development potential" under the town's future land-use map but staff concluded that R-15 would better align with the site context given a nearby railroad crossing and limited access points. He also noted the parcel is immediately adjacent to properties that are functionally residential and that no special flood hazard areas were mapped at the site.
Board members asked about access and easements for King Bruce Trail and whether existing decks or covered porches on the lot could be repaired or expanded under current zoning. Staff said recorded plats indicate King Bruce Trail functions as an access easement and that repairs are allowed for legally nonconforming structures but expansions would generally not be permitted absent further approvals.
A planning board member moved to recommend approval. The motion passed after a second; the chair announced the motion carried with Mr. Lazaro recorded as opposed. The board did not record a numeric tally in the transcript. The recommendation will go to Town Council for final action.
