Board vacates Rockport Street (County Road 429) to accommodate private owner access; utilities retain easements

Following public notice and a staff presentation, the Mendocino County Board of Supervisors on Feb. 25 adopted a resolution vacating Rockport Street (County Road 429) in the Rockport area and found the vacation exempt from the California Environmental Quality Act per the cited guideline.

Deputy Director Jason Wise of the Department of Transportation explained the vacation was requested by a private owner who has exclusive access off Rockport Street and that the county’s usual summary‑vacation consent process was not used because existing utility interests required a public hearing. Wise told the board there were no oppositions received to the proposed vacation after required public noticing. Utilities will retain rights of access; the street will be vacated from the public trust for transportation use.

Board action: After receiving the staff presentation, and hearing no in‑chamber or online public objections, the board voted unanimously to adopt the resolution vacating the right‑of‑way. The action included a CEQA determination as provided in the staff report.

Ending: The Board’s action transfers the county’s public right of way and preserves utility access rights; staff said the clerk had provided proper notice and related correspondence had been transmitted to supervisors prior to the hearing.
