Fisher told the commission that “they have agreed to contribute $30,000 towards off-site road improvements, for traffic impacted by the development,” and that the contribution “shall be payable to Oldham County Fiscal Court and due prior to any construction plan approval.”
Commission discussion focused on whether including a specific dollar amount in binding elements set a precedent. Commissioner Marsh asked whether the board was negotiating the amount; planning staff said the figure was an agreed amount negotiated beforehand between staff and the applicant. The applicant’s representative, Mr. Galloway, told the commission, “my client does agree to that.”
Commissioner Douglas moved to approve the development plan, saying the proposal complies with comprehensive plan objectives LU‑1‑1, LU‑3‑1 and T‑1‑1 and T‑1‑3 and Oldham County subdivision regulations and zoning ordinances; a second was recorded and the commission conducted a roll-call vote. The motion included approval of the binding elements listed by staff.
The roll call recorded 11 votes in favor, 0 opposed; the chair declared the motion passed 11‑0. Because the approval is limited to the plans presented at the Feb. 25 hearing, any subsequent changes to the plan must return to the Oldham County Planning Commission and the county engineer’s office for review. The staff report also noted that the plan must comply with all applicable federal, state and county ordinances and easement restrictions at the time construction-plan approval is sought.
The commission did not record any amendments to the motion. The binding-element requirements — specifically the $30,000 payment to Oldham County Fiscal Court and the pre-permit landscape and lighting submittal — are conditions the county will require before issuing construction approvals.
