Oldham County planning panel approves PZ-25-007 development plan with $30,000 road-improvement contribution

The Oldham County Planning Commission approved development plan PZ-25-007 at its Feb. 25, 2025 public hearing, voting 11-0 to adopt the plan along with a set of binding elements that require the applicant to contribute $30,000 toward off‑site road improvements.

Planning staff member Mr. Fisher read the recommended binding elements into the record: “The approval applies only to the plans presented at the 02/25/2025 Oldham County Planning Commission public hearing,” and the plan must be reviewed for any changes, comply with federal, state and county ordinances and easement restrictions, and include a landscape and lighting plan submitted to staff for review before any building permit submittal. The staff recommendation also stated the applicant would “contribute $30,000 towards off‑site road improvements for traffic infrastructure impacted by the development, which shall be payable to Oldham County Fiscal Court and due prior to any construction plan approval.”

Applicant representative Mr. Galloway told the commission his client agreed to the payment and asked for approval: “I think, just a very much wanted to thank everyone again for their time. I appreciate everyone's deliberateness and thoughtfulness in this project, and we request your approval. Thank you.”

Commission discussion focused on whether including a specific dollar amount in the binding elements set a precedent. Commissioner Marsh asked about precedent; Commissioner Baxter noted that the dollar amount had been negotiated between staff and the applicant rather than being set by the commission during the hearing. Baxter asked the mover to remove language saying the plan was in compliance with subdivision regulations; the mover agreed to that change during the motion. Mr. Fisher said the dollar‑amount language matched language previously used in a matter involving Paramount.

Commissioner Douglas moved to approve the development plan, citing consistency with comprehensive plan objectives LU‑1‑1, LU‑3‑1 and T‑1‑1/T‑1‑3 and Oldham County zoning ordinances; the motion incorporated the binding elements read by staff (with the struck language noted during the motion). The motion was seconded and carried on a roll call vote of 11‑0 (see vote record). Ms. Edgar announced the result: the development plan approval passed 11 to 0.

During other business, commissioners approved three hours of training credit for Miss Nassar and Mr. Klingenfuse for attending a Manufactured Housing Summit at the fairgrounds (date not specified). Planning staff also introduced Sandy Rugrodin as a new Planner I, noting the planning office was now fully staffed with four planners.

The approval is conditioned on the applicant’s fulfilling the binding elements — including the $30,000 payment to Oldham County Fiscal Court before any construction plan approval and submission of required landscape and lighting plans — and on adherence to the approved plans presented at the Feb. 25 hearing. The commission did not receive opposition testimony or a rebuttal during the hearing.
