Council amends cannabis overlay district, adds parcel adjacent to Sheetz

On Feb. 24 the Westminster Mayor and Common Council approved Ordinance 2025-03 to amend the city's cannabis overlay district, adding a property adjacent to an existing Sheetz location and maintaining the overlay at an existing dispensary site after hearing from the applicant and Planning & Zoning Commission amendments.
The Westminster Mayor and Common Council on Feb. 24 adopted Ordinance 2025-03, a sectional map amendment to adjust the boundaries of the city's cannabis overlay district.
Planning staff reviewed the ordinance background: the city adopted an initial cannabis overlay district in September 2023 (Ordinance 2023-06) that authorized floating zones for cannabis businesses. Two dispensaries currently operate in the city at 33140 Village Road and 700 Corporate Center Court. The Feb. 24 amendment would add a parcel (tax map parcel 4616307) adjacent to the existing Sheetz property and, as amended during Planning & Zoning Commission review, would not remove 33140 Village Road from the overlay at this time.
The Economic and Community Development Committee discussed the application on Oct. 10, 2024; the Planning & Zoning Commission held a public hearing on Feb. 20, 2025 and voted to amend Exhibit A to avoid removing the overlay from the existing dispensary addresses. Planning staff recommended the council approve the amended ordinance.
A representative for the applicant and the current dispensary owners addressed the council to voice support for the Planning & Zoning Commission’s amendment to maintain the overlay at the current dispensary location.
Councilmember motion and vote: Council moved to adopt Ordinance 2025-03 (motion recorded as moved by Councilmember Kovace and seconded by Councilmember Hoff). The council voted in favor and the ordinance was adopted.
Next steps: The amendment updates the map of suitable locations for city-designated cannabis overlay floating zones; any conversions or new dispensary site developments would be subject to applicable permits and separate approvals.
