Grove City board approves setback variance for ACM Realty at 4048 Park Mead Drive

The Grove City Board of Zoning Appeals on an uncontested vote approved a variance allowing ACM Realty to reduce the required building setback for a new commercial building at 4048 Park Mead Drive from 60 feet to 6 feet.
The variance was approved with three stipulations: the variance is contingent on approval of the development plan; the building may not encroach on the flood plain and no fill may be placed in the flood plain; and the variance is valid for 12 months during which the applicant must apply for development-plan approval.
Phil Mesinopoul, representing ACM Realty, told the board the property was purchased in 1992 and has been developed in phases. "We bought the land initially in 1992. In that same year, we constructed a 10,000 square foot building for the Power Shack gym. In '98, we added another curb cut on adjacent land and additional parking," Mesinopoul said, adding that the applicant later expanded by roughly 8,000 square feet for five commercial rental bays and now seeks to complete development with three additional commercial bays and 18 parking spaces.
A neighbor concern about existing parking was entered into the record. Laura (staff) read an email received from Melissa McCarthy that said residents and customers were concerned about a lack of parking and included a video showing limited spaces in the evening; Laura told the board that parking concerns are outside the Board of Zoning Appeals' jurisdiction and will be considered by the Planning Commission during the project's development-plan review. "Please note that 3 businesses were already closed. The daytime hours are much worse," Laura read from the submitted message.
Board members discussed the application and accepted the applicant's explanation that an existing storage building constructed after ACM Realty's original improvements supported allowing the same reduced setback on the new bays. The board formally moved to approve the appeal and adopted the three staff-recommended stipulations. Chair Halinga, Mr. Brandt and Mr. Hahn voted yes; the motion passed.
The applicant and staff were reminded that the variance approval does not remove the requirement to obtain development-plan approval before construction and that the 12-month limit requires the applicant to apply for that plan within a year.
No other public testimony on the item was reported at the hearing.
