New Orleans docket issues multiple consent judgments, continues several hearings to March 21

The City of New Orleans heard a series of permit-related enforcement items and civil consent judgments at a Feb. 21 sales tax hearing, approving multiple consent judgments, granting continuances to allow the city to perfect service and dismissing one petition after a renewal addendum.

City representative Jasmine Vandy said the city sought continuances in multiple matters “to the March 21 docket” while staff attempts to locate updated addresses and perfect service. The hearing also recorded consent judgments with payment deadlines in several cases and a dismissal after a license-holder submitted a renewal addendum.

The matters are routine docket items handled by the Department of Safety and Permits. Vandy said the city was “still unable to affect service” on Kirkoff LLC doing business as Next to Nothing and asked the hearing to continue that matter to the March 21 docket so staff could obtain an updated address. The hearing officer granted the continuance.

In a separate case, the parties in Enville Club Bar LLC agreed to a consent judgment for $5,000 payable to the Department of Safety and Permits within 90 days; the judgment was entered on the record. The city also moved to continue D K B Group LLC’s matter to a later docket to allow the parties to resolve outstanding issues.

Several other consent judgments were recorded on the docket: Lehi Food Incorporated (doing business as JC Food Market) for $1,200 payable within 180 days; Ports Orleans Brewing Company LLC (doing business as Hooks Orleans Brewing Company) for $3,200 payable within 120 days; New Orleans Steamboat Company Incorporated (Steamer Natchez) for $1,000 payable within 15 days; Riverboat City of New Orleans for $1,000 payable within 15 days; The Lounge on Milan LLC (Milan Lounge) for $1,400 payable within 30 days; and Aphrodisiac Enterprises LLC (Aphrodisiac in New Orleans) for $1,600 payable within 150 days. Each of those amounts and deadlines were stated on the record and entered as consent judgments.

The city requested a continuance in the case of 3B's Craft Burger and Wine (listed as 3 b's craft burger and wine) after certified mail was returned; the hearing officer continued that matter to March 21 so staff can update the address and attempt service again.

The Naka Institute Culinary LLC matter, represented by Amen Jaber, was continued to March 21 while the city and the respondent attempt to resolve how many months the nonprofit sold alcohol. When asked if the process differs for nonprofits, Vandy said “The process is exactly the same. It's just a matter of resolving the amount of months that they had. They submitted an addendum on the months that they did not sell alcohol, and we're trying to work that part out.”

In one item, the city filed a renewal addendum for Sushi Brothers Incorporated showing owner Junie Dang certified no alcoholic beverages were sold during the cited month; the city moved to dismiss that petition, and the dismissal was entered on the record.

At the close of the docket the hearing officer adjourned the session and set the next return date for the March 21 docket. No formal vote tallies were recorded on the transcript for the motions; approvals and continuances were announced on the record by the presiding official.
