ZBA tables Caliber Collision setback request at 4959 Genesee Street pending EAC and planning review

The Cheektowaga Zoning Board of Appeals tabled a variance application from Caliber Collision for 4959 Genesee Street, where the applicant requested a 4.4-foot side-yard setback on the west property line instead of the 10 feet required by code.
Robin Cerniak of GPI, representing Caliber Collision, told the board the design leaves 11.4 feet on the parcel’s east side and argued the narrower west setback is within a motor services district and would not abut residential lots. The applicant said vehicles would be stored in an operational (not junkyard) capacity behind a six-foot gated fence, with dark-sky compliant lighting and landscaping along the exterior of the fence.
Board members noted the application had been before the planning board and had been tabled pending EAC (Environmental Advisory Council) review; the ZBA said it prefers to receive planning-board and EAC recommendations before acting. One board member said the EAC meets next week and recommended tabling until that feedback is available. The motion to table was approved unanimously.
The applicant indicated the property has been vacant for years and described prior site work including a new pump station; the board expressed willingness to revisit the variance after EAC and planning feedback.
