Hallandale Beach commission adopts multiple ordinances, approves manager contract amendment

The Hallandale Beach City Commission on Feb. 19 approved four ordinances on second reading and a package of resolutions and administrative items, including a contract amendment for City Manager Dr. Earl that the commission approved 4-1 after extensive discussion about vacation rollover and compensation.

Why it matters: The ordinances and resolutions change local zoning, parking policy and departmental structure and adjust the fiscal year 2024-25 budget. Together those actions affect how development and transportation projects will be reviewed and how city operations are organized in coming years.

The commission voted 5-0 to adopt on second reading an ordinance amending the FY 2024-25 budget to reflect updated revenues, expenditures and appropriations. Commissioners also approved 5-0 changes to the zoning and land-development code to allow court and field recreational uses as accessory uses for commercial or mixed-use developments and to add a new section allowing administratively-granted parking reductions based on mitigation factors such as on-street parking, proximity to transit or affordable housing. The commission likewise approved 5-0 an ordinance creating a Transportation and Mobility Department to centralize traffic, parking and multimodal work.

On the budget ordinance, the mayor opened a public hearing, and with no members of the public speaking the commission adopted the item on a roll-call vote. On the zoning and parking items the commission held public hearings, received no public comment and adopted each item on second reading 5-0. Assistant Sustainable Development Director Steven Williams explained the parking-reduction item is intended to formalize reductions the city has already been authorizing and to streamline an administrative process; the code provides a baseline 10% administrative reduction and the new language sets percentage guidelines tied to previously issued variances.

The commission approved a resolution (4-1) to amend the city manager's employment agreement. The measure passed after a sustained discussion about vacation accrual, unused-time payouts and statutory limits on retroactive pay. Vice Mayor Lazaro, Commissioners Lee Matau, Adams and Mayor Joy Cooper voted yes; Commissioner Butler voted no. City Attorney Marino advised that Florida law limits retroactive payments for past service and that any bonus or payment for prior years must be structured carefully to comply with statute.

Other formal votes included a 5-0 approval of a resolution urging state legislators to create a public records exemption for personnel information of municipal clerks and employees involved with elections or code enforcement and a 5-0 approval to waive fees and allow use of OB Johnson Park for a Family Fun Day fundraiser whose proceeds will be given to a nonprofit after expenses.

The commission moved several consent items as a block with a 5-0 roll-call vote earlier in the meeting. The Transportation and Mobility Department ordinance was introduced by the city manager and drew public praise from multiple commissioners who said a dedicated department is needed to address traffic and parking complaints.

Looking ahead: The commission asked staff to continue implementation work, including hiring and operational planning for the new Transportation and Mobility Department and to return any technical changes required by codification. The city attorney also flagged statutory constraints that will guide implementation of any contract- or pay-related actions.
