Planning commission finds active development agreements in compliance during annual review

Staff reported the city’s seven development agreements were reviewed and staff concluded property owners and participants have demonstrated good faith and compliance; the commission voted to accept the review and recommended notification to council.
Beaumont Planning Commission on Feb. 12 completed its annual review of active development agreements and accepted staff’s finding that the parties are demonstrating good faith and complying with their agreements.
Katie Jensen, planning staff, reviewed the seven Development Agreements (DAs) subject to the city’s resolution governing DAs and said one agreement is complete, one is not yet active and five are in progress. Jensen said the annual review procedure (Article 6 of Resolution 1980734 in the staff report) requires the commission to determine compliance; if the commission finds noncompliance the matter can be referred to City Council for further action. Jensen reported no public comments were received during the notice period and recommended that the commission find all parties in compliance.
Commissioners asked about specific DAs. Jensen said Fairway Canyon’s DA expires in about two years and that if the developer needs more time they may request an extension to be considered by City Council. The commission also discussed an Exeter/Cherry Valley DA that staff listed as not active; Jensen said developer Exeter assigned existing entitlements and that prior industrial proposals were denied by council, and that Exeter has discussed other uses in the past.
The commission opened and closed a public hearing with no callers or written comments in person; commissioners then moved and voted unanimously to accept staff’s finding that property owners and participants have demonstrated good faith and compliance. The commission directed staff to transmit the review as a receiving file to the City Council so the council is aware of the status of active DAs.
Jensen noted Beaumont Point was not included in this year’s review because it is a new development agreement and will appear in next year’s report. The staff packet includes a chart listing each DA, the developer, start and end dates, term and project status, and a DA map showing locations around the city.
