Council sends petition to rezone front portion of 307 Concord Road to planning commission after BZA ruling

Anderson City Council unanimously referred a petition to rezone the front 210 feet of 307 Concord Road from R-15 (single-family) to LO (Limited Office), sending the matter to the Planning Commission for public review.
Maurice McKenzie, the plan development director, told the council the property is about 1.7 acres with double frontage to Pine Lane. He said the applicant previously sought NC (neighborhood commercial) zoning for the front portion in August 2024 to allow a food truck and other commercial uses, but the council denied that request as too intensive for the corridor.
After that denial, staff had interpreted the city’s zoning ordinance (section 14.2) to bar reconsideration of a petition deemed “substantially similar” for one year. The applicant appealed to the Board of Zoning Appeals (BZA). McKenzie said the BZA ruled in January that NC and LO are not substantially similar, which allows the applicant to reapply immediately for LO zoning.
McKenzie described LO as less intensive than NC: “It’s more office, personal-service uses in nature” and does not allow restaurants and retail. He also noted an adjacent parcel is already zoned LO and contains a barbershop.
Mayor Pro Tem Kyle Newton moved to refer the petition to the Planning Commission; Dr. Thompson seconded. The motion passed unanimously.
The referral will allow the Planning Commission to consider neighborhood context and uses permitted under LO and return a recommendation to council. McKenzie said the applicant intends only to rezone the front 210 feet along Concord Road and retain R-15 for the remainder of the lot.
