Planning staff reported the application had been before the board on Dec. 19 but that some materials arrived late and the public hearing was not noticed for this meeting. The applicant presented materials and requested the board re-notice and schedule a public hearing. Staff prepared a Part 2 with two potential small impacts, noting questions about a proposed common driveway and rear lot access. The board accepted the Part 2 and issued a negative declaration under SEQRA.
The board scheduled a public hearing for Feb. 20, 2025, to give the public a formal opportunity to comment. Staff said the applicant must confirm whether Burr Road meets the town's definition of a private road and provide documentation on any previous approvals for the common driveway. The board asked counsel to prepare a maintenance agreement for the common driveway and the applicant agreed to provide the additional materials.
The board also authorized drafting a resolution and directed staff to prepare notices for the re-scheduled hearing.
