Grayson County authorizes annual fireworks sale dates under state law; court discusses perpetual resolution

The Grayson County Commissioners Court voted Tuesday to authorize the county sale dates for consumer fireworks allowed under state law and discussed adopting a perpetual resolution to avoid annual action.

County staff explained that Texas law provides six annual selling seasons for consumer fireworks, two of which are guaranteed by state statute and four that a commissioners court may permit. The staff presentation noted neighboring jurisdictions treat sales differently: Collin County allows sales, Cooke County does not regulate, and Oklahoma allows year-round sales.

County staff said the resolution lists the dates before the court and asked whether the court wished to approve the four discretionary selling periods. The staff also suggested creating a perpetual resolution so the court would not need to act every year; a judge's emergency declaration or a local burn ban would still prohibit sales when conditions warrant.

Commissioner Arthur moved to authorize the sale dates as shown on the resolution; Commissioner Marr seconded. The motion carried with all voting "Aye." Court members did not change the dates on the record; staff said they will explore a perpetual resolution option for future meetings.
