Board refers School Seat donation back to committee after members seek clarity over check and procurement questions

The Memphis Shelby County Schools Board of Education on Dec. 3 voted to refer a proposed resolution to accept a $45,635.33 donation from School Seat Foundation back to committee for further review.

The donation item had been added to the consent agenda earlier in the meeting and moved toward approval, but several commissioners objected and asked for more information. Commissioner Murphy raised questions about why a donation check had been deposited in August without explicit board approval and cited a possible violation of district policy (Policy 2019). After debate, the board held a roll call on whether to send the resolution to committee for further review; the motion to refer carried with five votes in favor and four opposed.

Public comment preceding the action included remarks from Vincent McCaskill, who said his organization, School Seat, had responded to an RFP for homeless student identification and support, won that procurement process, and had not received a finalized contract. McCaskill told the board he had been informed by state officials the district could forfeit approximately $304,000 in state funds tied to the homeless identification work if the district did not complete contracting steps. McCaskill said he had attempted to obtain a correction after what he described as false public statements about School Seat’s operations at a prior meeting.

Superintendent Fagan and legal staff explained that board review of donations and related contracting procedures are standard and that referring the donation to committee would allow staff to clarify procedures and any compliance issues prior to acceptance. The referral means the donation will not be formally accepted or spent until the committee reports back to the full board.

The board’s action preserves further committee review of the district’s handling of the donation and related procurement steps.
