The Fishers Board of Zoning Appeals denied a variance request to permit digital changeable copy on two monument signs and on a gas station canopy at 11601 Alice Lingle Road.
Ross Hillery, director of planning and zoning, told the board the request (case VA-24-16) sought exceptions to the city's ground-sign standards to allow digital displays on monument signs and the fuel-station canopy. Hillery said the property is C-3 commercial and lies in a regional mixed-use portion of the comprehensive plan and that the existing pylon sign falls within land proposed for an intersection right-of-way improvement.
Hillery said the city had received no public comments on the petition and that the city was "currently in litigation" with the client over right-of-way improvements. He said city staff (SAP) recommended denial and that, if denied, the petitioner could file the same variance request again after six months unless a substantially different request was submitted sooner.
A member moved to deny the petition. After a second, the board recorded affirmative votes and the petition was denied. Board members recorded in the roll call as voting yes were Mister Silvey, Mister Stevenson and Mister Ferrucci.
The denial leaves in place the existing sign configuration and the proposed pylon sign location in the area affected by the planned intersection work. Hillery noted that, should the petitioner wish to reapply, the Unified Development Ordinance allows a resubmission after six months unless the director determines a sooner resubmission is substantially different.
