The City Council voted 5–1 on Dec. 2 to approve annexation 24‑2, PUD 24‑1, subdivision SUB 24‑6 and development agreement DEV 24‑2 for Emery Sky, a 37.67‑acre mixed‑use project proposed for the northwest corner of Moss Street and Lake Avenue.
The approved project includes 147 single‑family homes, seven duplex lots, 24 four‑plexes and one commercial lot intended for a daycare along Lake Avenue, for a total of 259 residential units. Staff and applicant noted infrastructure and access conditions; the council attached the conditions recommended in the staff report before approving the preliminary plat and development‑agreement modifications.
Why it mattered: The site is adjacent to existing single‑family neighborhoods and includes a parcel the applicant requested be annexed into the city. The project required PUD flexibility — and the council examined density, open space and transportation impacts before approving the plan. The approval was conditioned on documentation for bike parking, height compliance at building‑permit stage, and a prohibition against converting the daycare lot to residential uses without further approvals.
Key conditions and mitigations: Staff stipulated several site‑specific conditions: bike parking must meet code standards prior to construction drawings; building heights must meet underlying zone rules at permit review; the lot identified for daycare (Lot 3, Block 7) must be used for a daycare unless a conforming commercial use is identified; and other standard engineering and landscape conditions must be met. Engineering staff confirmed water and sewer service plans and noted development timing tied to infrastructure buildout.
Council discussion: Councilors praised the applicant’s design elements and the project’s buffer and open‑space provisions, but several asked for timelines on civil construction and when vertical construction might begin. Applicant representatives said construction documents and irrigation‑season timing would likely mean site work could start mid‑to‑late 2025, with home construction later.
Vote and next steps: The motion to approve the annexation, PUD, subdivision and development agreement (with staff conditions) passed 5–1. Staff will process construction drawings and the final plat; the development agreement must be recorded and construction plans approved before building permits can be issued.
Developer and community notes: The project will provide a range of housing types intended to be compatible with surrounding neighborhoods and includes a pathway along the canal and multiple on‑site amenities. The applicant said the daycare lot was sized and sited to serve the new neighborhood and nearby residents.
Bottom line: Emery Sky cleared its final city approvals with council conditions and will move into civil design and construction‑planning phases next, subject to compliance with the listed requirements and permits.
