The Town of Summer Planning Board voted to recommend that the town council approve an owner-initiated voluntary annexation of a 7.8-acre parcel off Myrtle Road owned by Warren Stansel of Interstate Outdoor Incorporated.
Town staff told the board the parcel is currently inside the town—s extraterritorial jurisdiction (ETJ), zoned IB (interstate business), not in a historic district and lies in Flood District AE. "The property he's looking to annex is a little over, I guess, a little over 7 acres," a town staff member said during the meeting.
Staff said the petition was submitted in late December and that the property meets the standards for annexation set out in General Statute 160A-58.1. The staff report noted five statutory items that must be met for annexation and stated that the parcel satisfies those requirements. Staff also said Johnson County GIS provided acreage calculations showing that including the parcel would not cause the town—s satellite corporate limits to exceed the statutory 10% limit; with this parcel included, satellite pieces would represent about 3.33% of the town—s total satellite area, according to staff.
Board members asked for clarifications about likely uses and limits on approvals. The staff member said the applicant had not specified a final use, though "he's in the billboard business," and staff assumed the owner might pursue signage; the applicant—s stated intentions were "not specified" in the record. Staff also said a formal survey from the applicant remained outstanding; staff said processing could continue while the survey was awaited.
After discussion, a board member moved to recommend that the council approve the annexation; a second was given and the motion carried with all members present voting in favor. The board—s action is a recommendation to the town council, which retains authority for final annexation decisions.
The board also noted the schedule for a future meeting and said the new town manager, expected to be in place soon, would likely stop by to meet the board. The recommendation and accompanying staff report will be forwarded to the town council for review and final action.
