The Texas Commission on Environmental Quality on Nov. 19 adopted a new non‑rule air quality standard permit authorizing natural‑gas electric generating units (EGUs) for use by owners/operators or for generation to sell electricity to the grid.
The permit is authorized under Texas Health and Safety Code §382.05195 and 30 Texas Administrative Code, Chapter 116, subchapter F. TCEQ staff said the new standard permit provides applicants more flexibility than permit‑by‑rule and typically shortens issuance timeframes: staff estimated standard permits average issuance around 20 days (the regulation allows 45 days).
Public process and comments: Notice was published June 28, 2024; a public meeting and comment period were held July 30, 2024. Staff reported receiving numerous public comments, mostly supportive; one commenter raised concerns about operational and emissions limits and record‑keeping but staff made no substantive changes to the draft permit in response.
The Office of Public Interest Counsel and the executive director supported adoption, with OPIC noting protectiveness findings and public outreach including materials in English and Spanish and translation accommodations. The commission voted to adopt the ED’s proposed order and issue the permit.
