The Texas Commission on Environmental Quality on Nov. 19 granted contested‑case hearing requests from Joseph Benavides and Austin Mark Ventures LLC challenging Crystal Clear Special Utility District's application to levy an amended impact fee in its service area and referred the matter to SOAH.
Commission staff and the Office of Public Interest Counsel reviewed the hearing requests and the commission concluded both requesters demonstrated individualized interests as property owners planning development within the utility district’s service area.
