Board delegates authority to executive director to approve online-course contract to avoid interruption of services

The Texas Board of Nursing delegated to its executive director the authority to approve and sign a contract with the vendor selected through a request for proposals for online nursing course services.
Assistant General Counsel Brian Miller told members state law (Texas Government Code Sec. 2261.254) requires board approval for contracts exceeding $1,000,000 but allows the governing body to delegate that authority to the executive director. Miller said the board's current contract for online learning services with eStrategy Solutions Inc. terminates March 1, and delaying a contract award could cause a lapse in services that licensees use for required coursework, jurisprudence testing and webinars.
A board member asked why the current contract exceeded $1,000,000. Miller said the vendor's unit prices had not increased but the larger licensed population in Texas increased total volume and pushed annual costs over the $1,000,000 threshold.
A motion to delegate the executive director the authority to approve and sign the contract was made by Rick Williams, seconded by Drew Riddle, and the board approved the motion. Board staff said the executive director will report the final award and contract terms to the board at the next meeting after signature.
