The Planning Commission voted unanimously Jan. 14 to forward a recommendation to the City Council to amend the zoning map for a portion of the property at approximately 4796 South 43100 West from RE20 (Residential Estates) to R17 (Single Family Residential).
The action would allow the applicant to subdivide roughly the northwest corner of the parcel into two lots and build one single‑family patio home on each lot. The applicant, Scott Wynne of Windruff Construction, said the property is about “an acre and a half” and that the proposal would leave roughly an acre on the original Covey parcel and convert the small corner into two R17 lots similar to the nearby Aspenwood Estates subdivision to the north. Wynne identified his company and gave an Ogden address during his remarks.
City planning staff described the request as consistent with the city’s future land‑use map, which calls for single‑family residential in that area, and recommended approval of the rezoning and that the commission forward a recommendation of approval to the City Council. Staff noted that existing farm or animal rights on the remaining Covey property would continue and that, if the rezoning is approved, the subdivision process would next determine the exact zone boundaries for the two lots.
The commission opened a public hearing; no members of the public spoke. During discussion a commissioner expressed concern about “spot zoning” in general terms, but other commissioners noted that property to the north is already zoned R17 and that the change would be a continuation of nearby zoning. One commissioner described the request as “pretty straightforward.”
A motion to forward a recommendation of approval to the City Council, with the conditions listed in the staff report, passed on a roll call vote with all commissioners recorded as “aye.” The roll call recorded votes from Commissioner Hobert (aye); Commissioner Bailey (aye); Commissioner Felt (aye); Commissioner Kelly (aye); Mr. Brand (aye); Commissioner Thompson (aye); and Mr. Tanner (aye). If the City Council approves the rezoning, staff said the applicant would proceed with the subdivision process to finalize lot lines and zone boundaries and then seek building permits for the two patio homes.
