The Finance, Administration & Economic Development Committee unanimously recommended two related redevelopment‑agreement actions involving properties at or near the southeast corner of 91st Street and Metcalf.
Glenwood Commons 4th amendment (Resolution 5016): Jim Mossman of the Stinson Law Firm presented a proposed fourth amendment to the Glenwood Commons redevelopment agreement. Mossman said the amendment permits a narrowly defined transfer mechanism that would allow the redeveloper to transfer certain tenant and common‑interest interests to specific entities (identified in the amendment). The amendment includes criteria intended to preserve the city’s visibility into who controls the property: the named acquiring entity must maintain a minimum ownership share (the amendment requires Double T to maintain 60 percent interest and the combined ownership interests to equal at least 75 percent) and the amendment recognizes limitations on further assignment. Staff described the changes as clarifications and edits requested by legal counsel for one of the parties; because the edits were substantive enough, staff returned the item to committee for approval. The committee voted unanimously to recommend adoption of Resolution No. 5016 approving the execution and delivery of the fourth amendment.
Wichita Metcalf assignment (Resolution 5015): The committee also considered an assignment of the redevelopment agreement related to a specific lot sale on the southeast corner of 91st and Metcalf. Staff said the action assigns the redevelopment agreement solely as it relates to the parcel being sold and releases Wichita Metcalf LLC from its obligations as to the transferred portion. The committee recommended council adoption of Resolution No. 5015 authorizing the transfer of the redevelopment agreement and release of Wichita Metcalf LLC with a unanimous vote.
Both actions were presented as limited, transaction‑specific edits or assignments. Staff said the items preserve the city’s rights and visibility into the ownership and operation of the relevant parcels; both recommendations will proceed to the full council for final adoption.
