TCEQ adopts amendments to Chapter 350 to update dioxin and PCB protective-concentration approaches

The Texas Commission on Environmental Quality on Jan. 16 adopted amendments to 30 Texas Administrative Code Chapter 350 to update approaches used to develop and demonstrate attainment of critical human-health protective concentration levels (PCLs) for dioxins, furans and dioxin-like polychlorinated biphenyls (PCBs).
Scott Sedemeyer of the Remediation Division and staff described the rulemaking: the proposed change updates outdated chemical-specific approaches and was published in the August 30, 2024 Texas Register; a public hearing was held Sept. 30, 2024 and the public-comment period closed Oct. 1, 2024 with no comments received. Staff recommended adoption and asked authority to make nonsubstantive revisions to meet Texas Register requirements.
Office of Public Interest Counsel staff said OPIC reviewed the package and supported adoption, noting the changes would affect a small number of sites, be more protective of human health, and allow the executive director flexibility as science evolves. Commissioners expressed agreement and adopted the amended rules by voice vote.
The amendments update chemical-specific approaches used to set human-health protective concentrations in the Texas Risk Reduction Program and aim to reflect current science while minimizing additional administrative burden.
