The Texas Commission on Environmental Quality voted Jan. 16 to grant Williamson County's hearing request and refer the petition by Lakshmi Land Group LLC to create Lakshmi Municipal Utility District No. 1 to the State Office of Administrative Hearings (SOAH). The commission also referred the matter to the agency's alternative dispute resolution (ADR) program to run concurrently with SOAH scheduling.
TCEQ staff told commissioners the proposed district lies entirely within Williamson County and that the county raised concerns connected to its statutory authority. "Williamson County is the sole hearing requester in this item, and their request raised relevant concerns connected to its statutory authority in this matter," staff said. The commission agreed the county is an effective person entitled to a hearing and ordered referral to SOAH and ADR. The motion passed on an affirmative voice vote.
The referrals begin the contested-case process and open the door for negotiated settlement discussions through ADR while SOAH schedules a hearing and record.
