Forsyth County commissioners back resolution to seek public hearing on Creek Ridge Lane right-of-way closure

Forsyth County commissioners voted unanimously Jan. 16 to adopt a resolution declaring the board's intent to close an unopened right-of-way off Creek Ridge Lane and to set a public hearing on the matter.

The resolution was moved by Vice Chair Wisenhunt and seconded by Commissioner Bessie. After staff and the county attorney answered questions about how nearby property owners and planning staff had reviewed the request, the board approved the measure without further discussion.

County planning staff told commissioners that the county typically routes right-of-way closure requests to the planning office for review; Planning Director Chris Murphy and his deputy directors and others on the planning team review the proposal and circulate comments by email. Planning staff said the area has existing alternate access routes: Country Cove Road and Old Hollow Road provide potential access to the larger parcel to the north, reducing the need for a new north-south street off Creek Ridge Lane.

The county attorney explained that, "unless the plat says something to the contrary," a vacated right-of-way would generally be split equally between the bordering properties, with the dividing line running down the middle of the former right-of-way.

Commissioner Linville asked for more detailed mapping in future staff packets so board members can see adjacent parcels and the surrounding subdivision layout when considering similar requests. Planning staff said they would provide wider-area maps going forward.

The motion carried unanimously. The resolution calls a public hearing to allow affected property owners and others an opportunity to speak before any final closure is approved.

The county will publish the hearing date and related materials as required by the resolution and state law.
