Ivins Planning Commission sets Feb. 4 public hearing for draft annexation policy plan

The Ivins Planning Commission on Jan. 14, 2025 agreed to schedule a public hearing for Feb. 4, 2025 on the city's draft annexation policy plan and discussed language and standards that will guide future annexation decisions.

The commission's discussion centered on how prescriptive the plan should be. Staff presented an edited draft and commissioners debated whether the document should require consideration of specific criteria in every annexation case (using the word "shall") or allow discretionary consideration (using "may"). Several commissioners said the criteria in Chapter 3 of the draft function as the standards the city should review when an annexation application arrives; staff and commissioners agreed that cross-referencing Chapter 3 would make the document clearer.

City staff described the draft as a tool to protect property rights and encourage sound planning. The document's Chapter 1 states the plan's intent "to protect and enhance the private property rights of the property owners within the municipal boundaries and in the unincorporated areas surrounding Ivins" and to "encourage sound planning practices and reduce the major sources of problems usually associated with the annexation process." Staff said the chapter-by-chapter criteria in Chapter 3 address fiscal capacity, municipal services and other considerations that must be evaluated in any annexation.

Commissioners also debated the legal weight of the plan's language. One commissioner noted that the ordinance guiding annexation policy plans requires a statement of criteria that will guide municipal decisions; several commissioners therefore favored retaining "shall" in the draft so the document clearly requires the commission and council to consider the listed items during a decision. Staff noted that if a criterion is not relevant to a particular application, the commission may conclude it has considered the item and found it inapplicable.

After discussion, the commission set a public hearing on the draft annexation policy plan for Feb. 4, 2025 and acknowledged staff members and consultants who prepared the draft. The commission also moved routine meeting business: it approved the Dec. 17, 2024 planning commission minutes and later adjourned the meeting.
