Votes at a glance: expulsions, personnel, legal defense, RFQs and district approvals

The Berkeley County Board of Education and its committees recorded multiple formal actions on Jan. 6, 2025, including decisions on student expulsion appeals, personnel recommendations, legal defense for the district in two court cases, committee awards of several architectural and roofing design RFQs, and committee approval of an out-of-state travel request and continuous improvement plans for underperforming schools.

Student expulsion appeals: The board considered appeals for five students whose cases were heard in executive session. The board denied the appeals of student numbers 1, 2, 3 and 4; denials were recorded with final tallies of 7-1 (student 1), 6-2 (student 2), 6-2 (student 3 after an initial procedural motion failed and a subsequent denial passed), and 7-1 (student 4). The board granted the appeal for student number 5 and assigned that student to the district's alternative school (vote 7-1).

Personnel and appointments: The board accepted administration personnel recommendations discussed in executive session by voice vote (ayes 8, nays 0). The board appointed Ruth Butka as principal of Berkeley Elementary School with a contract to begin Jan. 7, 2025; that appointment passed by voice vote (ayes 8, nays 0).

Legal defense and counsel engagements: As required by District Policy GBG and South Carolina Code citation noted in the meeting, the board voted to provide a legal defense for named defendants in Tiffany Richardson v. Berkeley County School District, case number stated in the meeting, and authorized Superintendent Anthony Dixon to execute documentation for legal engagement at hourly rates not to exceed the district's current general counsel's rate (motion by Miss Davenport; second; ayes 8, nays 0). The board also authorized the district to engage the law firm Nelson Mullins Riley & Scarborough LLP to represent the district and Superintendent Dixon in John Doe v. State of South Carolina, case number given in the meeting, jointly with Nelson Mullins's representation of the State Department of Education and State Superintendent Ellen Weaver (motion by Miss Littleton; second by Wofford; ayes 8, nays 0).

Committee procurement and personnel items: The capital planning committee considered RFQ 71324-25 (Architectural & Engineering Services for Berkeley High and Goose Creek High additions and renovations) and recommended awards to FW Architects Incorporated and Moseley Architects PC (committee vote 3-0). The committee also recommended award of RFQ 71524-25 (Roof Design Services for Sangaree Elementary) to WM Building Envelope Consultant LLC (committee vote 3-0). The finance committee approved out-of-state travel requests (committee vote 3-0). The academics and innovation committee accepted continuous improvement/turnaround plans for identified underperforming schools and authorized timely submission to the South Carolina Department of Education (committee vote 3-0). Committee votes were reported to the full board; the capital planning committee moved its Hanahan Middle School recommendation forward to the full board (the GMP was approved separately by the full board; see Hanahan article).

Other actions: The board approved updated board meeting dates for April (April 7 and April 22) by voice vote (ayes 8, nays 0). The meeting minutes and special meeting minutes for December were approved at the start of the Jan. 6 meeting.
