The Hutto Planning and Zoning Commission recommended denial, 4-0, of the Lydell Walker Phase 5 final plat, a proposal covering approximately 36.574 acres for 172 residential lots and two open-space lots, because staff identified outstanding technical comments and the application was subject to state statutory "shot clock" deadlines.
Staff told the commission the tract is in the Lydell Walker subdivision north of County Road 132 and west of County Road 133; the property was annexed and zoned SF-1 village in September 2021. Engineering and development-review comments remained open as of the packet due date, and staff said state law (the shot-clock statute) requires municipal action within the statutory timeline unless the applicant waives the shot clock. Because the applicant did not waive the shot clock, staff recommended denial per state law.
Commissioners raised a number of technical concerns in the staff packet: the applicant had waived a TIA earlier in the process, engineering comments noted that the property shape appeared to have changed from the previously approved report and that acreage appeared increased, and there were questions about whether the Mustang Creek lift station has sufficient capacity for additional wastewater load. Staff said engineering will track Lift Station capacity, LUEs and any infrastructure upgrades required if flow exceeds capacity.
One commissioner said the combination of a waived TIA and outstanding technical comments made denial the appropriate statutory action. Commissioners discussed resubmission and clearing of engineering comments and noted that final plat approval would require resubmittal and clarity on boundaries, drainage analysis and infrastructure capacity.
Commissioner Morris moved to accept staff's recommendation to disapprove (deny) the final plat under state shot-clock provisions; Commissioner Stewart seconded. The motion carried 4-0.
