Property owner Matthew Winfrey told the Linn County Commission on May 27 that he has used a driveway access from County Road 600 for approximately a year and that the Sugar Valley Lakes homeowners association (SVL HOA) had contested his access. Winfrey said he applied for a driveway permit and urged the county to place a culvert so he can access his property without further interference.
Winfrey said deputies visited recently after a neighbor reported a fence alteration; he told the commission he had cut a fence that crossed the access point he had been using and that a temporary driveway was installed by county crews shortly after the sheriff’s visit. He asked whether the county works for residents or for the HOA and expressed frustration that the county required HOA approval for driveway access onto a county road.
County staff took the matter under advisement and requested an executive session with counsel to review legal parameters governing driveway permits and easements. After consultation with county counsel, commissioners said they would gather the relevant permit paperwork, review the file and place the matter on the June 9 agenda at 11:15 a.m. so the parties can receive a county answer. Staff agreed to contact Winfrey with next steps and a meeting time.
Commissioners and staff noted the situation involves overlapping issues—private HOA rules, the county’s driveway/culvert permit process and property easements—and that counsel’s guidance would clarify whether county permitting can proceed without HOA consent or whether the HOA’s covenants affect implementation.
