Nancy Stauffer, the city’s HR director, explained the typical hiring process and said salary ranges and candidate expectations are generally settled before staff seeks council consent. Council members and the mayor discussed a dispute over sequencing: some members want the option to move from executive session directly to a public agenda item so the council can act on consent at the same meeting, while others said mechanics and statutory limits risk placing a candidate in an awkward position if an offer is made before formal council consent.
City Attorney Mark Bybee said state code allows a mayoral appointment before council consent but warned it could create an uncomfortable situation if council later withholds consent. Bybee and staff recommended revising the ordinance language to clarify sequencing and to align policy with state code. After discussion, the council voted to table Ordinance 20-25-05 and the related resolution R19-2025 to a date certain of March 4, 2025.
A motion to table was made, seconded and carried with recorded ayes; the item will return to council for revision and further consideration.
