The Saratoga Springs City Council on Feb. 4 approved the Sierra State Plat E application, allowing the applicant’s request despite a previous code threshold that would have required an additional petition process.
Staff described the parcel as a 26-lot plat. Because one street in the plat had fewer than 10 lots, the older version of Title 19 required a petition signed by 66% of property owners within a 500-foot boundary; staff said that threshold amounted to 97 lots. The applicant, identified in the meeting as Chuck Hale, submitted 74 signatures. Staff reported calling a sample of signatories to confirm signatures and said that all but a small number had verified their support.
Councilwoman Macomber noted that recent state law changes had imposed new, unfunded requirements on cities and expressed appreciation that the applicant had followed the process and engaged neighbors. The council discussed that many existing neighborhoods were developed with an expectation of single-family zoning; the petition process allows adjacent neighbors to waive or withhold rights under that state-directed procedure.
After council discussion, Councilman Wilden moved to approve the plat, the motion was seconded, and the council voted unanimously to approve business item 2, including staff findings and conditions.
The council’s action implements current provisions in the city’s Land Development Code (Title 19) as it applies to applications filed under the previous code rules. Staff noted the application was submitted before recent code changes and therefore proceeded under the earlier procedural requirements.
No additional conditions beyond staff findings were noted during the council discussion.
