Colorado Common Cause urges San Miguel County to back state Voting Rights Act to preserve local protections

Colorado Common Cause told the San Miguel County Board of Commissioners on Jan. 29 that the group and coalition partners are promoting a state Voting Rights Act (VRA) to preserve voting protections locally if federal enforcement weakens.

Ali Belknap, executive director of Colorado Common Cause, said recent U.S. Supreme Court decisions and a shrinking federal enforcement posture make a state law important: “What feels really, really important right now to us ... is that Colorado acts now to pass a state level Voting Rights Act so that we can codify those protections that the federal Voting Rights Act has offered since 1965,” Belknap said.

The proposal would adopt standards similar to Section 2 of the federal Voting Rights Act and give Colorado’s attorney general enforcement authority, the presenter said. The bill would also consider expanding requirements for multilingual ballots for municipal elections above defined thresholds.

Why it matters: Belknap said nine other states have enacted state VRAs and most have seen little litigation under those laws; Colorado’s proposed measure is intended to allow state courts and the attorney general to address practices that have a discriminatory effect on participation or representation in local elections.

Board discussion and follow up Commissioners raised implementation concerns and potential costs. Commissioner Lance Waring urged the sponsor to consider unfunded mandates: “You mentioned that you were still working through the details of the Spanish potential Spanish language ballot for various size, counties and electorates. I just urge you to consider very carefully unfunded mandates because if we are going to increase the complexity of our ballot, there will be some cost to that,” Waring said.

Belknap said organizers are working on practical options for municipalities and expressed willingness to continue stakeholder conversations. She asked for the county’s support and suggested local resolutions, letters, or advocacy at hearings would be helpful as the bill moves through the legislature.
