Wylie board approves 1-foot rear-setback variance for patio cover at 321 Wedgwood Way

The Wylie Zoning Board of Adjustment voted 5-0 on Jan. 21, 2025, to grant a variance allowing a patio cover to be built 1 foot from the rear property line at 321 Wedgwood Way, instead of the Planned Development requirement of 10 feet.
City staff described the proposal as a 200-square-foot attached patio cover, shown in the application as 25 by 8 feet. Staff said the subdivision is governed by PD 2019-15, which requires a 10-foot rear setback, and that the applicant submitted the variance request because the backyard and existing house sit close to the build line. The applicant was not present at the hearing.
Kevin Keelan, a city staff member, summarized the application and said the city mailed 31 notices about the public hearing and received one written comment in support from a neighbor across the street. Keelan said the homeowners association provided a letter that conditionally approved the work pending city permits. Keelan also noted the patio cover is unenclosed and attached to the house and that the submitted plan labels a retaining wall at the rear of the lot.
Board members discussed the small size of the lot and whether the structure's proximity to the fence and retaining wall raised drainage or utility concerns. A board member asked whether an engineering report addressing drainage had been provided; Keelan said no such report had been submitted. Another member noted that a detached accessory structure would normally require a three-foot rear setback, but that does not apply to an attached patio cover.
During discussion staff reminded the board it could modify the applicant's requested setback if members felt the 1-foot request was excessive. After closing the public hearing, a board member moved to approve the request "as submitted and listed on the agenda," the motion was seconded, and the board voted 5-0 in favor.
The meeting also approved the minutes from the previous meeting during the consent agenda and adjourned after the vote on the variance. Staff indicated the HOA's approval letter was conditional on the city permits being obtained; the record does not specify any additional permits or follow-up requirements beyond the normal permit process.
