The Genola Planning Commission discussed proposed changes to R-1 zoning to permit, in select cases, buildings within public-utility easements (PUEs) under controlled processes. Staff presented three approaches considered by the town: granting conditional permission with a recorded property-owner acknowledgement, requiring letters of consent from utility providers, or requiring an amended plat to vacate the PUE before permitting construction within the former easement.
Commissioners voiced concern about binding future owners to recorded agreements, the likelihood utility companies would ever sign waivers, and the possibility of utilities exercising eminent-domain in the future. Several members said that vacating a PUE via an amended plat, accompanied by recorded owner acknowledgements and, where available, letters from utilities, is the most practical approach. Commissioners emphasized the need to preserve the town’s ability to require utilities where later necessary.
After extensive discussion staff and commissioners agreed they were not prepared to adopt a definitive rule and moved to table the proposed R-1 amendment to allow building in PUEs. Staff was instructed to draft clearer language for consideration and to examine title-recording practices and potential consequences for title insurance and future utility actions.
The commission also discussed limiting the policy to R-1 and A-1 zones rather than a blanket allowance across all zones. No formal vote to change ordinances was taken; the item was tabled for future drafting and legal review.
