The hearing examiner recommended approval of a rezoning to MU‑2 and confirmed a declaratory resolution vacating the 15‑foot east–west alley north of East 10th Street for property known as 1708 East Tenth Street and 1017 Windsor Street (2025 CZN 811 / CVC 811).
David Kingen, representing RG Holdings LLC and Jackson Control Properties, said the property historically hosted light industrial uses (a sheet‑metal shop dating to at least a 1969 plan) and that the site’s commercial/industrial uses continued in later decades. Kingen and CEO Greg Erickson said Jackson Control currently uses the site for offices, training and light fabrication and needs improved, formalized parking and buffering so their operations can continue legally and in better condition.
The petitioners provided a site plan showing an expanded, reconfigured parking area, landscaping buffers along Windsor Street and commitments intended to preserve the existing company operations while enabling future mixed‑use redevelopment. The petitioner also requested vacation of a platted alley that has never been used as a vehicular alley; staff recommended the alley vacation and asked for a transportation easement and utility protections.
Councilor Zach Brown (district representative) spoke in support and noted neighborhood backing; staff recommended denial of a rezoning absent concrete mixed‑use development plans but supported the alley vacation. The hearing examiner recommended approval of the rezoning to MU‑2 (to be placed on the MDC agenda) and confirmed the alley vacation subject to a 15‑foot transportation easement and retention of utility rights under Indiana Code 36‑7‑3‑16.
Why it matters
The decision would regularize long‑standing industrial/office operations and allow the property to be brought into a zoning category (MU‑2) that matches the corridor’s mixed‑use pattern along East 10th. The alley vacation formalizes what is currently an unused platted alley and clears title and site‑planning obstacles to improve parking and buffering for neighboring homes.
