County staff reported the current code violation had been $720 and that, in many cases for large tracts, landowners find it cheaper to pay the fine than to abate the weeds. Staff and members of the county’s weed board proposed a new fee schedule: $1,000 for properties of 0 to 5 acres and $3,000 for properties greater than 5 acres. Staff said the proposed amounts would apply after the board’s letter and ticket process has been completed.
Staff and commissioners discussed enforcement mechanics, including that some neighboring counties have low fines or inconsistent enforcement, that some jurisdictions use daily fines, and that financing expense recovery (county crews or contractors doing abatement and placing a lien on the property) can create long-term accounts receivable issues for the county.
Commissioner Nichols said the purpose of violations is to induce corrective behavior and supported restructuring the fee schedule to encourage compliance. Commissioners discussed alternatives to per-day fines, including escalation for repeat or unpaid violations and caps on total amounts. Staff said the goal is zero fines issued if landowners comply, and staff sought consensus to proceed with drafting a separate fee schedule for noxious weeds distinct from the general nuisance schedule.
The board provided direction to work with county counsel and bring back proposed code language and a public-hearing schedule; no final ordinance or formal vote was taken at the meeting.
