Planning commission approves amended operating agreement for Scotty’s Diner with parking, curb and sidewalk conditions

The Milford Planning & Zoning Commission on May 20 approved an amended operating agreement for Scotty’s Diner that sets construction and site-improvement conditions to be completed by Oct. 31, 2025.

Planning Administrator Lisa Thompson told the commission the amended agreement — included in the commission packet — adds a deadline and specific improvements: install asphalt or concrete for two parking stalls (minimum size 9 by 19 feet), paint stall lines, pave the drive-through, and install sidewalk, curb and gutter along the west side of the property. A rolled curb shall be installed at the drive-through exit and painted red; the remaining curb shall be painted yellow. Thompson said the Connex container currently on site is temporary; while it remains, only one on-site parking stall will be available. The agreement removes prior requirements for bollards separating the drive-through and salon parking and removes the previously proposed entrance signage prohibiting blocking the alley.

Commissioner Garland Walker made the motion to approve the amended operating agreement for Melissa Wunderlich (Scotty’s Diner) with the conditions and Oct. 31, 2025 completion deadline. Commissioner Luke Ambrose seconded the motion, which was recorded as "Aye" and carried.

Thompson said she had notified the business owner of the changes and had invited her to the meeting; the owner was not required to attend. Staff said operating agreements ordinarily are revisited only if conditions are not met or if complaints prompt a review.

The commission did not attach additional enforcement timelines beyond the Oct. 31, 2025 completion date; staff will check compliance and bring the item back to the commission if necessary.
