County legal counsel reviewed draft language intended to limit employer liability where cannabis may be present in an employee’s system after lawful, off-duty medical use. The draft states county policy does not permit on-duty cannabis use or impairment in county workplaces, and that employees who operate county vehicles — especially DOT-regulated heavy-equipment drivers — remain subject to federal rules and county prohibitions.
Board members discussed uncertainty over how blood tests and impairment determinations are handled in criminal and civil proceedings. One supervisor described a scenario in which an employee who used medical cannabis at home could later test positive after an accident and attempt to use the Medical Cannabis Act as a defense; the draft policy language is intended to remove that defense in county employment actions.
Supervisors debated whether elected officials and those who drive county vehicles should be included. The board amended the motion during discussion to explicitly include elected officials and any person who operates county vehicles under the county driving policy; supervisors then approved the revised language by voice vote.
