A Hernando County special magistrate on Jan. 10 said recommended decisions denying relief will be issued for 17 separate property tax petitions after the petitioners failed to appear at hearings scheduled for 9 a.m.
The magistrate said the petitioners did not state good cause or request that the petitions be heard; the Hernando County Property Appraiser's Office confirmed the appraised values for each parcel and those values will be reflected in the recommended decisions. The magistrate repeatedly noted that any legal rights petitioners may have to pursue action in circuit court are not impaired.
The petitions, consecutively numbered 158 through 174, named mostly Ryan LLC as petitioner; petition 160 named Orion LLC. Each matter was addressed in turn on the record with the magistrate announcing the parcel key and the appraised (just) value and noting that assessed and taxable values matched the appraised amounts where stated. Examples from the record include:
- Petition 158 (Ryan LLC), parcel key 01208231: just value $410,043; assessed and taxable $331,925. - Petition 159 (Ryan LLC), parcel key 01570918: just value $404,041; assessed and taxable $397,375. - Petition 160 (Orion LLC), parcel key 00215742: just value $336,893; assessed and taxable $336,893. - Petition 163 (Ryan LLC), parcel key 00454494: just value $431,744; assessed and taxable $419,546. - Petition 166 (Ryan LLC), parcel key 00836821: just value $173,061; assessed and taxable $173,061. - Petition 171 (Ryan LLC), parcel key 00285391: just value $365,984; assessed and taxable $334,400. - Petition 174 (Ryan LLC), parcel key 00451503: just value $317,776; assessed and taxable $317,776.
(The full record lists petition numbers, parcel keys and values for each of the 17 matters; the Property Appraiser's Office confirmed each parcel's values and the magistrate said the recommended decision denying relief will be issued in each case.)
Procedure and next steps: the magistrate repeatedly recorded that evidence would be considered in the petitioners' absence. For each petition the magistrate stated a recommended decision denying relief would be issued and that petitioners retained the right to pursue matters in circuit court. The hearing concluded at about 9:43 a.m.
Because the matters were decided on the record and no petitioner appeared to present evidence or argument, the determinations reflected the Property Appraiser's Office figures and did not include further factual findings arising from petitioner testimony.
Copies of the recommended decisions will be issued as part of the hearing record; petitioners were told their statutory rights to pursue judicial review in circuit court remain available.
