Commission tables review of allowed uses and fines; discusses tightening definitions for treatment facilities

The Hooper City Planning Commission voted to table consideration of proposed changes to allowed uses and fines in the municipal code to a future work session so commissioners could review materials and prepare recommendations.

Staff provided commissioners with a draft of proposed uses and fines and asked commissioners to return with suggested edits. Commissioners and staff discussed prior public input and the need for clearer definitions for several categories, including children’s treatment service establishments and drug-and-alcohol treatment facilities. Staff and multiple commissioners said definitions currently in the code are inconsistent and that the commission should clarify terms such as the number of residents allowed in residential treatment settings and the difference between a children’s treatment facility and other treatment facilities.

Commissioners referenced previous meetings where law enforcement, recovery-service providers and others testified that certain facilities were not appropriately sited under existing code language. One commissioner recommended tightening definitions to specify age ranges (juveniles under 18), residential components (living, eating, cooking, sanitation), and treatment services (substance abuse, mental illness, developmental disabilities, court-ordered placements). The commission moved to table the item to the February 5 (recorded in discussion as Feb. 5 or Feb. 12 in different remarks) work session to allow time for review; the motion to table passed by voice vote.
