Valley County approves FY2024 indigent defense expenditure report; commissioners discuss state takeover and reimbursements

Staff said the county has a contract with the public defender that pays a monthly fee; the county’s report did not break down how that fee was distributed internally in the public defender’s office.
Commissioners asked about a spike in conflict‑related costs, and staff said $227,000 of the total represented conflict expenses tied to a capital murder case. The county reported receiving $87,000 back into the general fund from the Capital Defense Fund as a reimbursement for eligible costs submitted to the Idaho Administrative Commission.
Clerk staff confirmed the county had budgeted roughly $10,000 for unanticipated public-defense costs in FY2025 to cover items such as parental-rights termination cases, and said those costs would currently come from the county general fund while some reimbursement processes remain under dispute.
Staff and commissioners discussed recent state-level changes: the state has taken over responsibility for public defense expenditures as of Oct. 1 for fiscal year 2025. Commissioners and staff noted outstanding litigation and regulatory questions, including a recent Idaho Supreme Court ruling on transcript costs and ongoing disagreement about which entity is responsible for certain expenses moving forward. Staff predicted litigation and legislative sessions would continue to clarify responsibility for items such as transcripts, court-ordered evaluations and other case-specific charges.
The board voted to approve the FY2024 expenditure report and directed staff to provide further accounting details as requested.
