City Plan Commission approves Acacia Grove replat but rejects sidewalk exception

The El Paso City Plan Commission on Feb. 13 approved Acacia Grove Subdivision Number 2, Replat A, a resubdivision that creates two nonresidential lots on a 4.94-acre site east of Zaragoza Road and north of Montana Avenue, and denied an applicant request to waive a five-foot sidewalk along Montana Avenue.
Staff from Planning and Inspections described the proposal and recommended approval on a resubdivision/combination basis, noting that drainage would be handled by on-site ponding and that access would be from Montana Avenue. The applicant also requested an exception under El Paso City Code Title 19 to waive construction of a five-foot sidewalk to match surrounding conditions; staff said the request met the exception criteria but noted the site lies within a TxDOT right-of-way so final approval could be subject to TxDOT conditions.
Commissioners debated continuity of sidewalks in the area. Multiple commissioners and members of the public said sidewalks provide safety and neighborhood continuity; other commissioners said the surrounding pattern is inconsistent and that TxDOT preferences and future right-of-way changes could make a sidewalk premature. After a motion to approve the plat with the sidewalk exception failed, the commission reconsidered and approved the plat without the exception, requiring sidewalks per the staff report.
The applicant, Samuel Romero of H2 Ontario, said he was in agreement with staff comments and that TxDOT had not required sidewalks under their current administrative review, but that city approval was required to finalize the plat. Planning staff reiterated that because some frontage is within TxDOT right-of-way, TxDOT would have final say over any improvements in their corridor.
The commission’s action approves the replat; the applicant must comply with the conditions of approval in the staff report and with any TxDOT requirements that apply to the right-of-way.
