Board approves setback variance for Flynn property in Desert Hills to allow detached RV garage

The Maricopa County Board of Adjustment on Jan. 16, 2025, voted 5-0 to approve variance case BA240030 for the Flynn property in Supervisor District 3, allowing a reduced street-side (west) setback for a proposed detached RV garage.
County staff presented the case, noting the site is at 38627 North 20 Eighth Drive in the Desert Hills area, zoned RU-43 and approximately 1 acre in size. Staff corrected an exhibit label in the published report and explained that the applicant seeks relief from a required 20-foot street-side setback measured after a 14-foot-wide ingress/egress easement. The requested reduction would allow the detached RV garage to sit 13 feet from the ingress/egress easement (a 7-foot reduction) or 27 feet measured from the western property line for APN 20338007C.
Daniel (staff) told the board that the property is relatively flat and that staff had not identified an unusual physical condition that would prevent reasonable development. The applicant team — Jared Morris of Saddle Mountain Homes and owner Tom Flynn — presented renderings showing a sand-stucco, Santa Fe–style garage intended to match the house. Jared Morris said neighbors had signed letters indicating their support and that no one appeared to be present to speak in opposition.
During board discussion, Vice Chair Person moved to approve case BA240030 “subject to the language outlined in the staff report.” Member Carden seconded. Member Person said the ingress/egress easement creates a peculiar condition on the lot, a point that supported approval in the member’s view. A roll-call vote followed: Member Carden, Member Clapp, Member Ward, Vice Chair Person and Chairman Loper all voted yes. The board secretary announced the motion passed 5 to 0.
The approval memorializes a west yard/street-side setback of 13 feet measured from the ingress/egress easement (or 27 feet from the western property line) for APN 20338007C and authorizes construction of the proposed detached RV garage as described in the applicant’s materials.
No public testimony opposed the request, and staff and the applicant indicated that the detached structure does not currently exist; the presented images were renderings of the proposed garage.
